TERMS OF SERVICE

Welcome to Lawn Boutique and Landscaping LLC. These Terms of Service ("Terms") govern the relationship between Lawn Boutique and Landscaping LLC ("we," "our," or "us") and you, the client ("Client," "you," or "your"), for the provision of lawn care, landscaping, and related maintenance services.

By scheduling, accepting, or paying for our services, you agree to be bound by these Terms.

1. Services Provided

We agree to perform the lawn care and landscaping services described in your specific service estimate, quote, or digital invoice. Any changes, additions, or deviations from the original scope of work must be agreed upon in writing (email or text is acceptable) and may result in additional charges.

2. Access and Property Preparation

• Access: Client must grant our crew full access to the property on scheduled service days. This includes unlocking gates, securing pets, and ensuring a clear path to the work areas.

• Obstructions: Client must clear the lawn/work area of toys, tools, pet waste, lawn furniture, large rocks, and debris prior to our arrival. We are not responsible for damage to items left in the yard, nor are we responsible for delays caused by blocked access.

• Pets: For the safety of our crew and your animals, all pets must be kept indoors or safely contained outside of the work area during service.

3. Scheduling and Weather

• Timing: While we attempt to maintain consistent schedules, service days and times are estimates.

• Weather Delays: Lawn care and landscaping are highly dependent on weather conditions. Inclement weather (heavy rain, extreme heat, snow, or saturated ground) may delay your service. We will reschedule your service for the next available clear day.

4. Pricing, Payments, and Fees

• Invoicing: Services are billed based on the payment terms outlined in your estimate or invoice (e.g., per-visit, monthly flat rate, or a deposit for large landscaping projects).

• Due Date: All payments are due upon receipt of the invoice unless otherwise specified in writing.

• Late Fees: Past-due balances will accumulate a $15.00 late fee per month until paid in full.

• Suspension: We reserve the right to suspend or cancel ongoing services if an invoice remains unpaid past its due date.

5. Cancellations and Modifications

• One-Time or Routine Service: To cancel or reschedule a regular lawn maintenance visit without penalty, you must notify us at least 24 hours in advance.

• Landscape Projects: Deposits made for custom landscaping projects, plantings, or hardscaping materials are non-refundable once materials have been purchased or ordered.

6. Underground Utilities and Property Damage

• Underground Lines: It is the Client’s responsibility to inform us of any shallow, non-utility, or unmarked underground items, such as invisible dog fences, private irrigation/sprinkler lines, low-voltage lighting wires, or drainage pipes. We are not liable for damage to items not clearly marked or communicated prior to digging or aerating.

• Public Utilities: For major digging projects, we will coordinate with Georgia 811 utility marking services as required by law.

7. Limit of Liability

• Turf & Plant Health: We use standard professional practices. However, we cannot guarantee the survival of lawns, plants, or shrubs against natural elements beyond our control, including drought, extreme frost, pest infestations, diseases, or under/over-watering by the Client.

• Maximum Liability: To the maximum extent permitted by law, the total liability of Lawn Boutique and Landscaping LLC for any claim arising out of our services shall not exceed the total amount paid by the Client for the specific service giving rise to the claim.

8. Termination of Service

Either party may terminate a recurring service agreement at any time by providing written notice 14 days prior to the next scheduled service. Client remains responsible for paying for all services rendered up to the date of termination.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict of law provisions.
